New regulations for the use and cultivation of cannabis

With the reform of the legal framework on the sale of medicinal substances and the fight against drug addiction (Loi du 19 février 1973 concernant la vente de substances médicamenteuses et la lutte contre la toxicomanie), the cultivation and consumption of cannabis is allowed in Luxembourg under certain conditions.

Cultivation and use

The consumption of cannabis or cannabis products by an adult person in his or her home or usual place of residence is now authorised. Consumption and possession elsewhere and consumption in the presence of minors are prohibited, as is the transport and acquisition of cannabis or cannabis products.

However, the domestic cultivation of up to four cannabis plants per domestic community (indoors or outdoors) is permitted. This may only be done from seeds. These must be labelled with the name of the producer, the number of seeds and a health warning. The plants must not be visible to the public.

Penal sanction

At the same time, a simplified criminal procedure was introduced for various offences.

The agents of the Grand Ducal Police and the officials of the Customs and Excise Agency can issue fines in the following cases:

  • Consumption of cannabis or products derived from the same plant in a place other than one's home or habitual residence: €145.
  • Transport, possession or acquisition (against payment or free of charge) of 3 grams or less of cannabis or products derived from the same plant for personal use: €145.

In addition, for various other offences, such as consumption in the presence of minors, failure to comply with the prescribed place of cultivation, or the purchase, transport and possession of quantities of more than 3g, fines and/or prison sentences, can be imposed by a court in the event of a trial. Drugs and driving

Driving under the influence of drugs is prohibited. Although cannabis consumption is permitted under certain conditions, it may affect the driving of vehicles or handling of machines. Depending on the quantity and frequency of cannabis consumption, the level of THC in the blood can reach or exceed 1ng/ml, in which case driving constitutes an offence to the road traffic regulations.
